Mortgage Foreclosure Sales
Mortgage foreclosure sales are scheduled with and held by the Bay County Sheriff's Office. Sales are held Monday through Friday at either 10:00 a.m. or 11:00 a.m. at the southern, front entrance to the court facility housing Circuit Court. Deeds and fees must be received in a reasonable amount of time in advance of the sale date. A $50.00 Sheriff's fee is required to hold a mortgage sale. The length of the sale is one hour. Increments of bidding will be agreed upon by interested parties and the officer present who will document the same. If the property is sold, the successful purchaser will have a one hour period to secure a certified check in the amount of the sale bid price. This check, along with fees and purchaser information, must be returned for deed correction and later recording. If the property is not sold, signed, witnessed, and notarized, deeds will be returned for later recording. Recording takes place with the Bay County Register of Deeds. Their fees are separate. Any overage proceeds above bid price from the sale will be deposited with the Bay County Clerk's Office for the redemption period as noted in the deed.
